Terms of service
The terms under which Handyland provides Zelixy.
What governs the use of this website and a Zelixy subscription, where no separately signed contract says otherwise.
Scope
These terms cover the use of this website and, where no signed agreement says otherwise, Zelixy subscriptions. Zelixy is offered to businesses only. Where a signed contract exists, that contract prevails over anything on this page. Your contracting partner is Handyland, Heidelberg, which holds the official right to operate Zelixy in Germany. Zelixy is a product of Daleenda For IT Developments, which develops and operates the platform for Handyland and holds the contract for the certified cloud TSE.
The service
Zelixy is a restaurant system of fifteen modules, each bookable on its own or together as Complete: Sales, Ordering, Delivery, Reservations, Kitchen, Purchasing, Finance, Control, People, Guests, Companies, Inbox, AI assistant, Screens and Online presence. What each module includes is described on the Features page as of the order date. Onboarding, menu setup, training and support in German are part of every module.
Prices, setup and payment
Prices are per location and exclude VAT. Each module carries a monthly fee and a one-time setup fee charged when the module is first added; the setup fee can be spread over twelve months with a ten percent surcharge. Complete is invoiced as one subscription. Annual prepayment covers twelve months for the price of ten. Card and online payments processed through Zelixy carry a fee of 2.5 % plus €0.25 per transaction for EU cards; other cards and payment methods at their own rate plus 1 %. Messaging is metered and drawn from a credit balance; Complete includes €20 of credit every month. Clients contracting in Germany are invoiced by Handyland, with German VAT shown; invoices are due within fourteen days.
Term and changes
The initial term is twelve months, after which the subscription continues month to month. Modules can be added at any time and removed at the end of a month. A second and every further location receives 40 % off every module and 20 % off Sales. Either side may end the subscription with thirty days' notice to the end of the term; Handyland may end it earlier only for non-payment after reminder or misuse of the service.
Customer obligations
The restaurant provides accurate tax data and the information needed for the TSE registration and the tax-office register, keeps its content, prices and legal details current, and uses the service lawfully. The setup depends on access, decisions and content arriving when they are needed. Where they do not, timelines move by agreement rather than quality being cut to hold a date.
Compliance
The till uses a certified cloud TSE, produces KassenSichV-compliant receipts, logs cancellations without deletion and exports DSFinV-K. Changes required by law — new DSFinV-K versions, receipt rules or registration duties — are part of the subscription and not a paid upgrade. The procedural documentation (Verfahrensdokumentation) is provided; the restaurant remains responsible for its own tax filings.
Data ownership and export
The restaurant's data belongs to the restaurant. It is hosted in the European Union, processed under a data-processing agreement, and can be exported at any time during the term and for thirty days after it ends. Pre-existing components, open-source dependencies and our own general know-how remain ours, licensed to you as far as your use of the service requires.
Availability and support
Zelixy is operated as a hosted service, with the till able to sell offline and sign when the connection returns. Phone and chat support in German during opening hours, with an emergency line for till issues. Planned maintenance is announced in advance and placed outside service hours where possible.
Confidentiality
Each side keeps the other's non-public information confidential, during the subscription and afterwards, and uses it only for the service. We name a restaurant publicly only with its agreement.
Liability
Handyland is liable without limit for intent, gross negligence and injury to life, body or health. For ordinary negligence, liability is limited to the breach of essential contractual duties and to the damage typical for this kind of contract, capped at the fees paid in the twelve months before the event. The website itself is provided as it is: its content is information, not advice, and visiting it creates no engagement.
Termination and handover
On termination, work completed is invoiced, the restaurant's data is exported on request, and access ends thirty days after the last day of the term. Hardware the restaurant owns stays with the restaurant.
Governing law
Subscriptions contracted with Handyland are governed by German law, with the courts of Heidelberg where the law allows a choice of forum. Other contracts name their governing law and forum in the signed agreement.
